Welcome to PicaPool! These Terms and Conditions ("Terms") govern your use of the PicaPool mobile application ("App") and any related services provided by PicaPool ("we", "our", "us"). By using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Use of the App:

Eligibility: The App is intended for use by individuals aged 13 and above. By using the App, you represent and warrant that you meet this age requirement.

Account Registration: To use certain features of the App, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as needed to keep it accurate, current, and complete.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account

User Conduct:

You agree not to use the App for any unlawful purpose or in any way that might harm, disrupt, or interfere with the functionality of the App. You agree not to post or share any content that is offensive, inappropriate, or violates the rights of others.

Group Purchasing:

Offer Pool Creation: Users can create offer pools to take advantage of special offers within a specified radius.

Payment: If all participants do not complete their payments, any amounts paid by the participants will be refunded within one business day.

Permission:

Location Permission: We require access to your location to show users all the people in their vicinity while pooling for an offer. We ensure that your location data is anonymized in our database to protect your privacy.

Notification Permission: We require permission to send you notifications to keep you informed about special offers, updates, and important information related to your use of the App.

Phone Number: We need your phone number for carpooling purposes. This allows us to connect you with the driver and other participants in the carpool.

Camera/Gallery Permission: We require access to your camera and gallery to allow you to upload pictures of offers when creating or joining a pooling offer. This helps in providing a visual representation of the offers to other users.

Privacy:

Our Privacy Policy explains how we collect, use, and disclose information from our users. By using the App, you agree to the collection and use of your information as described in the Privacy Policy.

Third-Party Services:

The App may include links to or integrate with third-party services. PicaPool is not responsible for the content, policies, or practices of any third-party services. You are encouraged to review the terms and policies of any third-party services you use.

Intellectual Property:

All content and materials available on the App, including but not limited to text, graphics, logos, and software, are the property of PicaPool or its licensors and are protected by intellectual property laws. You agree not to use, copy, or distribute any such content or materials without our prior written consent.

Termination:

We reserve the right to terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.

Limitation of Liability:

PicaPool shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App by any third party; or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the App.

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

Changes to Terms:

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the App. You are advised to review these Terms periodically for any changes. Your continued use of the App after any modifications to the Terms constitutes your acceptance of the new Terms.
